Can Your Employer Drop your Health Insurance Benefits While Out On

We are often asked by clients if their employer can drop their Health insurance benefits while they are out on Workers? Compensation. Unfortunately, the short answer is ?Probably yes.? There is no law in Pennsylvania that requires an employer to pay for health insurance premiums while you are disabled from work due to a work-related injury.

If your employment is governed by an employment contract for a collective bargaining agreement, that agreement may compel your employer to continue paying health insurance premiums during an absence from work. Absent such an agreement, your employer is not obligated to continue to pay your premiums. However, if there is no such agreement, we must look elswhere

Under the Family and Medical Leave Act (FMLA), you are entitled to 12 weeks of leave if your employer is large enough and you have enough hours. If you apply for leave under FMLA, your employer must preserve your health insurance benefits, as well as your job, for 12 weeks. However, if you made a contribution toward your health insurance premiums when you were employed before your injury, you must continue to make those contributions while out on Worker?s Compensation.

If your health insurance policy is about to be canceled, you must receive a COBRA notice from your employer. This will allow you to continue coverage, but you must pay for your own premiums. As you can see, there is very little protection of your health insurance coverage while you are disabled from work due to a work injury.

Is Facebook Working on a Branded Smartphone?

On one side, you have Vivian Wagner. She notes that Facebook CEO Mark Zuckerberg, on his company's earnings call, flatly stated that building a smartphone ?wouldn't really make much sense for us to do.? She also pointed to a Facebook spokesperson who said ?Our mobile strategy is simple: We think every mobile device is better if it is deeply social...We're working across the entire mobile industry, with operators, hardware manufacturers, OS providers, and application developers to bring powerful social experiences to more people around the world.?

While Wagner notes that these comments don't explicitly rule out the possibility of Facebook working on a smartphone, there are other barriers. Zuckerberg isn't dumb; when he says it wouldn't make much sense for his company to work on a smartphone right now, it's because he knows his company's strengths and limitations. Think about all the things that would go into creating a smartphone. The social network would need to change its entire business model, or at least modify it heavily. According to tech consultant Eric Brown, ?Dealing with manufacturing, suppliers, distributors, returns, inventory, seasonal sales cycles ? these are all concepts that are presently foreign to a social network management firm selling advertising.?

And yet, the idea of Facebook developing its own branded smartphone seems to be a rumor that just won't die. Adrian Kingsley-Hughes?covered it on Friday for ZDNet. According to him, Facebook is collaborating with HTC to bring a Facebook-branded smartphone to market by some time in 2013.

If the Bloomberg?story Kingsley-Hughes cited can be believed ? always risky when the sources in the item refuse to be named ? it sounds very nearly like a dream team working on the project. At least, it could potentially be an interesting marriage of technologies. Facebook is supposedly working on a modified operating system for the device, which may be based around Google's Android OS, and has assembled a team of Apple programmers to move things forward. Does anyone other than me find the mix of Apple, Google, and Facebook influences on this rumored project to be...intriguing? Possibly even too good to be true?

Kingsley-Hughes thinks Facebook has both a motive and the ability to develop such a smartphone. For the former, he points to the fact that so many Facebook users are browsing the site on mobile platforms, but the social network's ad income relies on them browsing on the desktop. Apparently Facebook's own app hasn't redressed that issue, but perhaps putting out its own smartphone might. For the latter, he simply points to help from HTC, which would presumably get around a lot of the issues raised by Brown.

But Kingsley-Hughes puts his finger on the real issue ? and that isn't whether Facebook could create a smartphone if it had a compelling reason, but whether that phone could successfully compete against what is already out there. As he points out, ?It's not like there aren't a lot of cheap handsets out there already.? And how, exactly, will Facebook convince its users to get a Facebook handset just to see ads?

Kingsley-Hughes suggests that Facebook could take the Amazon route, by offering a dumbed-down version of Android on its phone, and perhaps heavily subsidizing it with ads. Going that route is a gamble, and could leave the company bleeding money. And Brown seems to think it might not succeed: ?To be successful, the device would need to invisibly integrate all the smartphone features with [the] Facebook system ? email, photo sharing, check-ins, etc...A 'chat' and 'videochat' app would most likely be included as well ? both using the Facebook ecosystem.? That doesn't exactly sound like a dumbed-down smartphone, or the kind of phone you'd get if the device were heavily subsidized.

No, it makes a lot more sense to assume that Facebook is simply working closely with lots of hardware manufacturers to get functionality for its website's features more tightly integrated into a wide variety of smartphone devices. Then again, even Wagner observed that this wouldn't be the first time a CEO has played coy while keeping a project under wraps before it's ready to be revealed. We'll just have to wait and see.

HSBC says sorry as it takes $700 million hit

LONDON (AP) ? HSBC PLC apologized to shareholders Monday as it disclosed a $700 million charge to cover the cost of U.S. penalties for lapses including its failure to enforce money-laundering controls in Mexico.

The provision was announced as Europe's biggest bank reported an 11 percent advance in pretax profit in the first half of the year following $4.3 billion in gains from asset sales. For the six months ending June 30, the bank made a pretax profit of $12.7 billion, up from $11.5 billion a year earlier.

As well as costs relating to infractions in Mexico, the $700 million provision also takes in possible penalties for violations of the U.S. Bank Secrecy Act in a case going back two years, and any penalties from continuing investigations of possible violations of economic sanctions against Iran and other countries.

Earlier this month, HSBC paid a fine of $28 million ? 379 million Mexican pesos ? to Mexican authorities for non-compliance with money laundering controls.

A U.S. Senate investigative committee reported that in 2007 and 2008 HSBC Mexico sent to the United States about $7 billion in cash. "Bulk cash shipments could reach that volume only if they included illegal drug proceeds," the committee concluded.

HSBC Mexico acknowledged in a statement that it failed to report 39 suspicious transactions and had been late in reporting 1,729 others.

The bank's chairman, Douglas Flint, and Chief Executive Stuart Gulliver apologized for the money-laundering infractions.

"We must demonstrate that we have learned from earlier mistakes," Flint said.

"The banking industry is operating in a hostile climate so we must double our efforts to convince our regulators, customers and investors that we are striving for the highest possible standards. Only that way can we allay public fears and regain trust in our industry," Flint said.

Gulliver said new processes and standards were being enforced in all of the bank's global operations.

"HSBC is now run and managed as a genuinely global firm, making it easier to set, monitor and enforce standards," he said.

As well as being dented by the money-laundering provisions, HSBC's first-half earnings were also hit by provisions of $1.3 billion for compensating U.K. customers for payment protection insurance.

However, the bank made no provision for settling potential regulatory fines and private lawsuits, including one pending in the United States, related to setting the London interbank offered rate (LIBOR) and other indexes.

In its program of getting out of non-strategic markets and non-core investments, HSBC has made 36 disposals and closures since early 2011.

A further look at the figures showed that operating income was up 3 percent to $43.7 billion while taxes paid more than doubled from $1.7 billion to $3.6 billion. However, net profit was down 8.6 percent to $8.4 billion, compared to $9.8 billion a year earlier.

HSBC shares were up 0.8 percent at 535.2 pence in late morning trading in London.

Although the first half profits fell short of analysts' forecasts, Jonathan Jackson at Killik & Co. said he rates the shares as a buy because HSBC has a "strong funding position, with excess cheap deposits, and is well capitalized."

First Pisa, now Rome's Colosseum - it's leaning

ROME (Reuters) - The ancient Colosseum of Rome, where gladiators fought for their lives, is slanting about 40 cm (16 inches) lower on the south side than on the north, and authorities are investigating whether it needs urgent repairs.

Experts first noticed the incline about a year ago and have been monitoring it for the past few months, Rossella Rea, director at the 2,000-year-old monument, said in an article published in the Italian daily Corriere della Sera on Sunday.

The Leaning Tower of Pisa, another of Italy's most popular attractions, was reopened in 2001 after being shut for more than a decade as engineers worked to prevent it from falling over and to make it safe for visitors.

Rea has asked Rome's La Sapienza University and environmental geology institute IGAG to launch a study on the phenomenon, with investigations to be concluded in a year.

Tests have also started to observe the effects that traffic on nearby busy roads may have on the monument.

Professor Giorgio Monti, from La Sapienza's construction technology department, warned there may be a crack in the base below the amphitheatre.

"The slab of concrete on which the Colosseum rests, which is like a 13-metre (yard)-thick oval doughnut, may have a fracture inside it," he told the newspaper.

He said intervention could be necessary if the concerns are confirmed, along the lines of stabilization work carried out in Pisa, but he said it was too early to judge what kind of intervention would be most suitable.

The Colosseum - famous for hosting bloody gladiator fights in the days of the Roman Empire - attracts hundreds of thousands of tourists and is usually packed with visitors.

Mitt Romney On Taxes: Overpaying Disqualifies President

JERUSALEM -- Mitt Romney says that if he paid more taxes than were required, he wouldn't be qualified to be president.

The U.S. presidential candidate tells ABC News that American voters expect candidates to pay "only what the tax code requires." He says he hasn't calculated what percentage of his income was paid in taxes but says that he's been audited.

Romney's vast personal wealth has been an issue in the campaign.

Democrats have criticized him for paying only 13.9 percent of his income in taxes during the one year his taxes have been made public.

Romney says he will release an additional year of returns before Election Day. That has left some questioning whether Romney pays a smaller share than other Americans.

They?re Not Creepy

I believe that Britain is best represented by those who dare to think different. Those who aren?t afraid to fail. From the logo to the Olympic Park to the mascots themselves, the organizing committee could have played it safe but they didn?t. Those decisions, in my opinion, reflect a dynamic, forward-looking nation. With the mascots we wanted to celebrate the diversity and richness of modern Britain. So we asked ourselves why have one or two mascots when we could have hundreds of thousands or even millions?

APNewsBreak: Irish slam Google data deceit

LONDON (AP) ? An Irish data protection officer says that Google's retention of Street View data in violation of agreements made with European governments is "clearly unacceptable."

The Mountain View, California-based company angered regulators in several countries in 2010 when it acknowledged that its mapping cars, which carried cameras across the globe to create three-dimensional maps of the world's streets, had also scooped up passwords and other data being transmitted over unsecured wireless networks.

Google was supposed to have deleted the data, but it acknowledged Friday that it had retained some of it.

Ireland's Deputy Information Commissioner Gary Davis says his organization had conveyed its "deep unhappiness" to Google and wants answers by Wednesday.

Gene fusion is behind deadly brain cancer Mutiny Radio

Treatment for a lethal form of brain cancer could be on the horizon after the discovery that the cancer can be formed by two genes fusing together. People with the disease could potentially benefit from drugs that block the activity of a protein produced by this wayward fusion.

Cancers can be sparked by a number of genetic mutations, including disruptions to single parts of a gene that either over-stimulate or castrate an important protein. But some cancers arise when two entire genes are accidently fused together during natural cell replication. The protein that the fused genes code for performs some of the functions you would expect of it but does so in new locations or contexts. ?They do their thing, but incorrectly,? says Anna Lasorella at the Institute for Cancer Genetics at Columbia University, New York.

Lasorella and her colleagues studied the genes involved in a lethal form of brain cancer called glioblastoma. About 3 per cent of the glioblastoma tumours they looked at were caused by the fusing of two genes.

On its own, each gene has an important but benign function. When fused together the two wreak havoc during cell division. The protein that the fused genes code for latches onto the spindles that pull freshly replicated chromosomes into two new cells during cell division. The interference means that instead of an even division, the cells end up with different numbers of chromosomes: a phenomenon known as aneuploidy. ?It?s a well-known hallmark of cancer,? says Antonio Iavarone, also at Columbia.

Having identified this mechanism, the team wanted to check that the fused genes actually cause this form of cancer. So they injected the newly formed protein into the brains of healthy mice. Ninety per cent of the mice went on to develop the expected glioblastomas.

The team then administered a drug that blocked the activity of the new protein. In doing so, they were able to double the mice?s survival time.

Because the protein is specific to the cancer cells, the team predicts that drugs to target it would cause minimal damage to healthy cells.

The superlative growth of China over the last decade has largely been fueled by export demand for cheaper Chinese-made goods. The country built thousands of plants and added significant capacity to handle the significant influx of foreign business. While this strategy works when global economies are strong, the problem arises when export demand declines as we are seeing now in China.

The current structure of the country?s growth is largely dependent on foreign demand for goods, but China realizes that it also needs to drive domestic consumption higher to help minimize the negative impact of any global slowing when moving forward, and to create a more balanced economy that is powered by both export demand and domestic consumption.

The International Monetary Fund came out earlier this week and suggested China?s economy is facing ?significant downside risks,? advising the country to try to increase domestic consumption instead of just pumping money into the economy. If you go to China, you?ll notice tens of thousands of empty apartments that were built by the government with no tenants. You also see this with excess manufacturing capacity. China has spent hundreds of billions on infrastructure, but consumer spending is key.

China has made it clear that it wants to stimulate domestic consumption, which currently stands at around a third of its gross domestic product (GDP) compared to around 70% in the U.S.

With over 1.3 billion people and a middle-class of around 300-400 million (depending on who you talk to), the strategy to boost domestic consumption makes a whole lot of sense.

In its 12th Five-Year Plan for 2011-2015, China indicated it wants to make the country less dependent on export demand and investment-led growth, and to try to promote equal income distribution that would allow its lower-income citizens greater access to money. This, in turn, would pump up domestic consumption, at least in theory.

The reality is that China?s exports are declining as the global economies continue to face growth issues. (Read ?Global Economies Backtracking.?) There is also a decline in domestic consumption, which is a key area the Chinese want to address and improve.

China has made clear its intentions to pump up its economy with stimulus and make consumers want to spend. Interest rates have been lowered, and with inflation well below the top target, there is more room for rates to fall.

The hope is to make it so attractive the Chinese consumer will want to borrow and spend.

Republicans could take some solace in the fact that the $84 billion figure is down from $210 billion that the CBO had estimated in 2011 due to a variety of factors, including the Supreme Court?s ruling, changes in the rate of growth of Medicare, and the Department of Health and Human Service?s decision to halt the implementation of the law?s long-term care insurance provision.

But Democrats have to contend with the CBO?s estimate that some 3 million more Americans will go without health-care coverage in 2022 due to the Supreme Court?s ruling. Costs are going down while coverage is also declining because, as the CBO writes, two-thirds of those who will find themselves without Medicaid coverage will also be unable to access state health insurance exchanges.

If the law is fully repealed, as many as 30 million? Americans, however, would be without health care insurance by 2022, according to the CBO.One conservative health-care analyst did see a benefit from potential repeal, however.

NEW YORK (CNNMoney) -- Turns out there's a price to pay for incessant fighting in Congress and political grandstanding.

The federal government spent an extra $1.3 billion to borrow last year because of the showdown over the debt ceiling, the Government Accountability Office reported Monday.

Republicans in Congress and the Obama administration were locked in battle for months over how to raise the country's legal borrowing limit.

"Delays in raising the debt limit can create uncertainty in the Treasury market and lead to higher Treasury borrowing costs," the GAO said.

Indeed, even though bond rates were low last year, the GAO found that the Treasury Department paid a premium on many government securities in the eight months leading up to the eventual deal in August.

The premium reflected the relative risk of government securities to private-sector debt.

Rates on private-sector debt are typically higher than those on government bonds. But the difference between the two narrowed in 2011.

In other words, investors demanded the government pay higher rates than it would have on federal debt with due dates of two years or more.

The GAO, the country's official auditor, also noted that the longer term costs of the 2011 debt limit fight will be higher, since the interest costs that Treasury locked in during the first eight months of the year will be paid out over time.

There were intangible costs as well amidst the months of uncertainty that preceded lawmakers' deal to raise the debt ceiling and the subsequent downgrade of the country's credit rating by Standard & Poor's.

"[M]anaging federal debt ... was complex, time-consuming, and technically challenging," the GAO said.

Congress, of course, will eventually have to raise the debt ceiling again. Exactly when is unclear.

The legal borrowing limit is currently $16.394 trillion.

As of last Thursday, the country's accrued debt stood $559 billion below that limit. If the government continues to run monthly deficits between $100 billion and $125 billion, the debt load may approach the ceiling as early as mid-November.

But Treasury can buy some time with so-called extraordinary measures such as suspending contributions to federal pension plans.

Has Congress learned its lesson about the risks of political brinksmanship ? Apparently not.

For starters,House Speaker John Boehner in May issued the same ultimatum on the debt ceiling that he issued in 2011. He said any debt ceiling increase must be accompanied by an even larger amount of spending cuts.

Since then, both parties have engaged in a battle over the so-called fiscal cliff -- a series of large, overnight tax increases and spending cuts. Combined they would hurt the economy in the short-run if Congress does nothing to replace them with more gradual deficit-reduction strategies.

Just what lawmakers will do about the cliff -- and when -- is unclear. And that uncertainty is already thought to be hurting the economy through a slowdown in hiring and a reluctance among businesses to invest.?To top of page
